NHMTA Extension of Regional Declaration of Emergency from US DOT

Attached is the Amended Regional Declaration of Emergency Waiver from the US DOT. This waiver extends the Hours of Service waiver covering 37 states and the District of Columbia to January 28, 2018.

The FMCSA waiver covers both intra-state and inter-state shipments of heating fuels including heating oil, kerosene and propane.

Please keep a copy of this Declaration in the cab of your truck.

NHMTA Regional Declaration of Emergency

Dear Member,

The US Department of Transportation has issued a Regional Declaration of Emergency under 49 CFR 390.23. The Declaration is for 38 states and grants emergency relief from Parts 390 through 399 of Title 49 Code of Federal Regulations with some restrictions, and includes the transportation of fuel products into and rom the Affected States and jurisdictions.

NHMTA Massachusetts HOS Waiver

Dear Member,

The State of Massachusetts has issued an HOS Waiver for transportation of heating fuels. The notice is attached.

An emergency exists that requires relief from regulations adopted in Massachusetts and
Federal Statutes and Regulations pertaining to hours of service of motor carriers and
drivers of commercial motor vehicles, while transporting and delivering fuels necessary
for the continued heating of homes, businesses and other structure and the continued
delivery of liquified natural gas to electrical generation facilities and energy customers.

This emergency exemption is effective immediately and will remain in effect until 11:59
P.M., EST, January 9, 2018, unless rescinded sooner by appropriate order.

A copy of the attached waiver needs to be placed in the cab of your truck.
