On July 7, the NYS Tax Department mailed out more than 100,000 tax refund checks, amounting to $44.4 million, to interstate motor carriers that were part of a class action lawsuit brought by the Owner Operators Independent Driver Association (OOIDA). OOIDA had sued the state on the claim that the HUT registration and permit fees were “flat taxes”, discriminating against interstate carriers who typically run less miles in the state than intrastate carriers. The refund checks will expire after 90 days so any carrier that receives a refund should deposit them promptly.
Carriers in the class are entitled to keep refunds for taxes that were paid exclusively by the carrier. However, if carriers charged back any HUT registration and permit fees to independent contractors who worked for them, the carrier is required to reimburse the full amount of those fees back to the independent contractor without regard to any claims or setoffs.
